Acceptable use policy

This Acceptable Use Policy outlines the terms and conditions governing the use of hosting and related services provided by Optimum Web Host. It defines the obligations of both the user ("You") and Optimum Web Host ("We," "Us," "Our") regarding the use of these services. By using our Website or services, you acknowledge and agree to this Acceptable Use Policy.
1. User Obligations Content Responsibility: You must ensure that your content does not violate any laws, infringe intellectual property rights, or promote illegal activities. You must own or have authorization to use the content hosted on Optimum Web Host’s servers.
License to Optimum Web Host: You grant Optimum Web Host a license to cache your content for performance optimization, and you agree that this does not infringe on your or any third party’s intellectual property rights.
2. Network Interruptions / Downtime Optimum Web Host will strive to maintain uninterrupted service but is not liable for damages resulting from network downtime caused by factors like utility interruptions, equipment failure, natural disasters, or human error.
Liability is capped at the total amount of the Fees paid by you for the affected Services in the 12 months prior to the claim.
3. Accounts This policy applies to all accounts, sub-accounts, and associated names. You are responsible for all activities under your account.
Accounts cannot be transferred without prior written approval from Optimum Web Host.
4. IP Addresses Optimum Web Host assigns IP addresses to users, but the rights to these IPs remain with Optimum Web Host. Users have no ownership or transfer rights over the assigned IPs.
5. SSH Access SSH access is granted on a provisional basis. Misuse of SSH access, such as circumventing policies, will result in account termination.
6. Trials, Promotions, and Discounts Promotions and discounts are provided for new or secondary services, not for replacing existing services.
Abuse of discounts or promotions may result in account suspension or termination.
7. Prohibited Content and Activities You are prohibited from hosting, distributing, or engaging in illegal, harmful, or offensive content or activities, including but not limited to:
Nudity and pornographic content Hate speech and discrimination Illegal activities (e.g., hacking, fraud, copyright infringement) Violent or extremist content Malware and harmful software Harassment and cyberbullying Child exploitation Intellectual property infringement Proxy services and VPNs Spam and unsolicited emails
Optimum Web Host reserves the right to determine violations and take action, including account suspension, termination, or reporting to authorities.
8. Email and Anti-SPAM Policy You must comply with the CAN-SPAM Act of 2003 and other relevant regulations.
Prohibited activities include:
Sending unsolicited bulk emails Email header forgery (“spoofing”) Hosting services that support spam
Deliberate or reckless spamming may result in a €1200 fee and sharing of your information with anti-SPAM organizations.
9. Resource Limitations Shared hosting services are intended for normal web usage, not for file distribution or excessive resource consumption.
Activities like running IRC servers, gaming servers, or file-sharing services are prohibited.
Accounts exceeding resource limits may be suspended or terminated.
10. Backup Limitations Accounts using more than 10GB of disk space or containing over 200,000 inodes may be excluded from backups.
Users are responsible for maintaining their own backups. Optimum Web Host is not liable for data loss.
11. Email Services Email usage is subject to limits on the number of emails sent per hour, mailbox size, and concurrent connections.
Optimum Web Host may block or queue emails at its discretion.
12. Hosting Upgrade Shared hosting accounts can be upgraded to more advanced hosting plans. Fees are non-refundable, and prorated amounts from shared hosting will be credited to the new account.
13. IPv4 Usage Policy Shared hosting accounts are limited to 1 IP address.
14. Storage and Security Users are responsible for maintaining the security and confidentiality of their accounts and content.
Optimum Web Host services are not intended for data backup or archiving. Misuse may result in account termination.
15. Third-Party Software Optimum Web Host provides third-party software (e.g., Direct Admin, Softaculous) on an “as-is” basis. Users are responsible for any additional licensing fees.
16. Reservation of Rights Optimum Web Host reserves the right to:
Modify pricing and service terms. Terminate accounts for violations, non-payment, or harmful activities. Refuse service to anyone at its discretion.
17. Limitation of Liability Optimum Web Host provides services on an “AS IS” basis and disclaims all warranties, including merchantability and fitness for a particular purpose.
Optimum Web Host is not liable for: Service suspensions or interruptions. Data loss or corruption. Unauthorized use of accounts or passwords.
18. Legal Age Users must be at least 18 years old to enter into this agreement. Optimum Web Host reserves the right to terminate agreements with minors.
